GTC
1. Scope of application
These General Terms and Conditions (hereinafter referred to as GTC) apply to all rights and obligations arising from the business relationship between calmego GmbH and its customers.
2. Order placement / conclusion of contract
Orders can be placed via the online shop as well as by e-mail, telephone or social media channels. By placing an order, the customer recognises the GTC. The binding purchase contract is concluded when the ordered products are dispatched.
3. Changes and cancellations
Changes or cancellations of orders received are possible after written or telephone consultation with calmego GmbH, provided the order is not yet ready for dispatch.
4. Prices
All prices are in Swiss francs, including VAT. The product prices stated at the time of ordering are binding.
5. Shipping costs
Shipping is free of charge for orders over CHF 59. The shipping costs for orders under this amount are CHF 5.90.
6. Payment
For electronic payment methods, the time of payment corresponds to the time of the order. The deadline for invoice payment is 30 days. In the case of purchase on account, calmego GmbH reserves the right to carry out a credit check at its own discretion. Irrespective of the result of this check, the acceptance of orders may be refused in individual cases or only accepted against advance payment.
7. Delivery
All orders received from Monday to Friday by 17:00 will be dispatched on the same day by PostPac Priority. Delivery usually takes place on the next working day (Monday to Friday). After verbal or written agreement, collection at the registered office of calmego GmbH can be arranged.
8. Complaints
The customer is obliged to check the products upon receipt. Complaints must be sent by e-mail to kontakt@calmego.ch within 5 days of the delivery date.
9. Right of return
The products can be returned within 5 days of receipt. The prerequisite for this is that at least 90% of the contents are still present and that a reason relating to the goods and the telephone number are enclosed. In this case, 100% of the product costs will be refunded. If these criteria are not fully met, the original invoice remains valid.
10. Default of payment
Any payment reminders will be sent to the registered e-mail address. A fee of CHF 12 will be charged for the 3rd reminder. After the 3rd reminder, calmego GmbH may commission third parties with the collection and is authorised to assign the invoice claim(s) to third parties. Third parties may charge additional fees.
11. Data protection
calmego GmbH does not pass on any customer data to third parties, with the exception of data necessary for the provision of services and fulfilment of the contract (e.g. to shipping service providers, payment processors, credit agencies and debt collection service providers).
The customer has the right to free information, correction and deletion of his/her data stored by calmego GmbH at any time.
12. Place of jurisdiction
All legal relationships between the customer and calmego GmbH are subject to Swiss law. The place of fulfilment and place of jurisdiction is the respective registered office of calmego GmbH. However, calmego GmbH is entitled to sue the customer at the competent court of his/her place of residence.
13. Amendment of the GTC
calmego GmbH reserves the right to amend the GTC. Such amendments come into force immediately upon their publication. The version of the GTC valid at the time of the order is decisive, which cannot be changed unilaterally for this order.
